Mark Diamond

Special Counsel
Mark Diamond is a Special Counsel at Hall Payne, working in Sydney’s employment and industrial relations team. He is admitted to both the Supreme Court of NSW and the High Court of Australia and is an Accredited Mediator.
Mark Diamond Senior Associate

During his career, Mark has had carriage of, or been involved in, hundreds of complex employment and industrial matters across federal and state jurisdictions. His experience includes unfair dismissals, general protections, discrimination, whistleblower protections, workplace health and safety, bullying and harassment, disciplinary processes, redundancies, underpayments, protected industrial action, suspensions of industrial action, enterprise agreement disputes, and union rule changes.

Mark has represented clients before the Federal Court of Australia, the Federal Circuit and Family Court of Australia, the Fair Work Commission, and State industrial courts and commissions, including, at times, appearing as advocate.

Mark joined Hall Payne having worked for the Australian Rail, Tram and Bus Industry Union (RTBU), first as its National Lawyer before ascending to serve as its National Secretary. His time at the RTBU was characterised by significant legal work as well as contributions to the union’s activities, advocacy for workers’ rights, and changes he pursued in the industries in which the RTBU operates.

Mark has served on various boards, including the Jobs and Skills Council for the Transport and Logistics industry, a harm prevention charity for the rail industry, and the Australian Council of Trade Unions (ACTU) Executive.
